Venezuela-related sanctions by the United States Department of the Treasury - update V

Note: This Announcement, first published on 4 February 2019 and updated on 5 February 2019, 12 February 2019, 6 March 2019 and 8 March 2019, has been updated again to give further information. The changes have been highlighted.
Clearstream Banking1 refers to the publications made by the United States Department of the Treasury on 17 April 2019 with regards to Venezuela.
Clearstream Banking reminds customers of the requirement to comply, and ensure compliance by any of the customer’s underlying clients, with any applicable law or regulation.
Customers are additionally requested to note the following operational requirements:
Instructions to receive securities covered by General License 3E
When instructing the receipt of any of securities covered by General License 3E, customers must add the following new representation into the narrative field of their instruction (for example, field :70E: of the MT54x instruction):
“We represent: this instruction is covered by OFAC General License 3E; is ordinarily incident and necessary to transfer or divest, or to facilitate the transfer of the securities to a non-U.S. person; no SDN is involved; the ultimate recipient of the securities is neither a U.S. person nor an SDN or SDN equivalent.”
Note: Section (c) of GL 3E authorises transactions and activities that are ordinarily incident and necessary to the wind down of financial contracts or other agreements that were entered into prior to 16:00 Eastern Standard time on 1 February 2019, involving or linked to GL 3E bonds. This authorisation is valid until 00:01 Eastern Standard Time on Moday, 30 September 2019.
Instructions to receive securities covered by General License 9D
When instructing the receipt of any of securities covered by General License 9D, customers must add the following new representation into the narrative field of their instruction (for example, field :70E: of the MT54x instruction):
“We represent: this instruction is covered by OFAC General License 9D; is ordinarily incident and necessary to transfer or divest, or to facilitate the transfer of the securities to a non-U.S. person; no SDN is involved; the ultimate recipient of the securities is neither a U.S. person nor an SDN or SDN equivalent.”
Note: Section (d) of GL 9D authorises transactions and activities that are ordinarily incident and necessary to the wind down of financial contracts or other agreements that were entered into prior to 16:00 Eastern Standard Time on 28 January 2019, involving or linked to PDVSA securities. This authorisation is valid until 00:01 Eastern Standard Time on Monday, 30 September 2019.
Instructions to deliver to the domestic market securities covered by General License 3E and General License 9D
For domestic market settlement, the customer delivering securities to the domestic market must either provide the same representation, or alternatively, represent that the instruction relates to an on-exchange transaction and the customer has no information in their possession leading it to know or to have reason to know that the ultimate buyer is a U.S. person.
Note: If for some reason it is not possible to add the representation to the narrative field of the instruction, we require a separate authorised communication which must provide the Transaction Reference(s) to allow reconciliation of the representation back to each instruction.

Clearstream Banking 1 si riferisce alle pubblicazioni fatte dal Dipartimento del Tesoro degli Stati Uniti il 17 aprile 2019 per quanto riguarda il Venezuela .

Istruzioni per ricevere i titoli coperti dalla Licenza generale 3E
Quando si istruisce il ricevimento di uno qualsiasi dei titoli coperti dalla Licenza Generale 3E , i clienti devono aggiungere la seguente nuova rappresentazione nel campo narrativo della propria istruzione (ad esempio, campo: 70E: dell'istruzione MT54x):
"Rappresentiamo: questa istruzione è coperta dalla Licenza Generale OFAC 3E ; è ordinariamente incidente e necessario per trasferire o cedere, o per facilitare il trasferimento dei titoli a una persona non statunitense; nessun SDN è coinvolto; il destinatario finale dei titoli non è né una persona statunitense né un equivalente SDN o SDN. "
Nota: la sezione (c) di GL 3E autorizza le transazioni e le attività che sono ordinariamente incidenti e necessarie alla fine di contratti finanziari o altri accordi che sono stati stipulati prima delle 16:00 Eastern Standard il 1 ° febbraio 2019, con o collegati a GL 3E obbligazioni. Questa autorizzazione è valida fino alle 00:01 Eastern Standard Time on Moday, 30 settembre 2019 .

Nota: la sezione (d) di GL 9D autorizza transazioni e attività che sono ordinariamente incidenti e necessarie alla fine di contratti finanziari o altri accordi stipulati prima delle 16:00 Eastern Standard Time del 28 gennaio 2019, che coinvolgono o sono collegati a Titoli PDVSA. Questa autorizzazione è valida fino alle 00:01 Eastern Standard Time di lunedì 30 settembre 2019 .
Istruzioni per la consegna ai titoli del mercato nazionale coperti dalla Licenza Generale 3E e dalla Licenza Generale 9D
Per il regolamento sul mercato interno, il cliente che consegna titoli al mercato nazionale deve fornire la stessa rappresentazione o, in alternativa, rappresentare che l'istruzione si riferisce ad una transazione in borsa e il cliente non ha informazioni in suo possesso che lo portano a conoscere o ad avere ragione per sapere che l'acquirente finale è una persona statunitense.
Nota: se per qualche motivo non è possibile aggiungere la rappresentazione al campo narrativo dell'istruzione, è necessaria una comunicazione separata autorizzata che deve fornire il / i riferimento / i della transazione per consentire la riconciliazione della rappresentazione fino a ciascuna istruzione.
