Sarà difficile che ci togliamo di dosso tanti anni di apprensione per i sacrifici di tante famiglie per il comportamento ladresco degli infami.
Con Alessandro ieri abbiamo fatto al telefono una breve ma significativa rassegna di cosa abbiamo cercato di mettere in atto per dare fastidi a quei farabutti.
Parimenti non dimentichiamo tutti noi stessi per l'assistenza che ci siamo fatti per tutti quei lunghi anni.
Per esempio abbiamo ricordato con rabbia quando, la kapponassa ospite dell'Hotel Eden, quelli del suo staff si dannavano a telefonare al mondo intero italiano per farci togliere davanti con i nostri due striscioni. Così addirittura ci fu detto dai due funzionari di Questura che se non andavamo via ci avrebbero tolto gli striscioni. Diìovemmo cedere alle evidenze che non ci rimaneva che "obbedire".
Eravamo in 4, come ricorderete, io, Marisa, Antonio e Roberto (mandato da Pietro Paganini) che fece alcune foto.
La rabbia che viene che una dimostrazione di estrema correttezza fu oppressa da decisioni di ossequio ai ladroni e di assoluta non democrazia.

Para frenar corrida, el BCRA subió fuerte la tasa y vendió u$s 1.382 M: el dólar cerró $ 20,90







Luedo de la sorpresiva decisión de incrementar la tasa de política monetaria al 30,25% y las ventas por u$s 1.382,1 millones en el mercado cambiario del Banco Central, el dólar recortó su avance inicial y subió este viernes seis centavos a $ 20,90, en bancos y agencias de la city porteña, según el promedio de ámbito.com.

El billete llegó a subir 36 centavos, a su récord histórico intradiario $ 21,20, pero luego recortó con la decisión de la autoridad monetaria de subir su tasa de política monetaria 300 puntos básicos a 30,25%, desde el 27,25% anterior, una medida sorpresiva si se considera que el tipo de interés de referencia se anuncia cada segundo y cuarto martes de cada mes al cierre del mercado.

"Se tomó esta decisión con el objetivo de garantizar el proceso de desinflación y está listo para actuar nuevamente si resultara necesario", destacó la entidad que preside Federicio Sturzenegger en un comunicado.

De esta manera, la moneda terminó el mes con una suba de 44 centavos. Sucedió pese a que la autoridad monetaria sacrificó u$s 4.731,2 millones en ese período, mientras que en la semana desembolsó u$s 4.343,7 millones y desde marzo vendió u$s 6.776,1 millones.

El economista Guillermo Nielsen alertó por la salida de divisas del Banco Central y estimó que la inflación de abril puede superar el 2,5%.

El exsecretario de Finanzas de la Nación, Guillermo Nielsen, alertó por la abrupta salida de dólares de la Argentina, el impacto en los precios de la microcorrida cambiaria y reclamó al Gobierno nacional por más atención en la política monetaria. "Estamos frente a un problema, hay que ser claro", subrayó el especialista.

Aún quedan $ 20.000 millones de Lebac en manos de extranjeros


El desarme de posicione originó la corrida que esta semana forzó a la autoridad
monetaria a vender casi u$s 4500 millones de las reservas y subir las tasas. De aquí al
próximo vencimiento quedan $ 20.000 millones más en manos de extranjeros que podrían
no renovarse.

reservas tuvo su origen en la salida de fondos extranjeros que estaban invertidos en Lebac.
De aquí al próximo vencimiento
quedan $ 20.000 millones más en manos de extranjeros que podrían no renovarse. Además, los bancos que compraron las
letras a los fondos del exterior también podrían dejar que se venzan

Siete d'accordo se chiediamo al nostro Cricket di cambiare un po' il titolo del nostro thread, dato che praticamente tutto quello che riguarda TFA è tutto, credo, messo a posto.
Continuiamo per esempio con: ARGENTINA MERVAL 55 HOLDOUTS CON BOND PRESCRITTI OD ALTRO

Se avete qualche idea migliore ditemelo che poi chiediamo di cambiare l'attuale. Non mettiamo niente sui cartacei, perché penso che non ci sia più nessuno in Italia, mentre in Germania la cosa è molto sentita.

La fatídica conferencia de prensa del 28 de diciembre pasado sigue teniendo sus consecuencias y ayer el BCRA vendió 853 millones de dólares que, sumados a los 200, 400, 1400 de los tres días anteriores, suman 2900 millones de dólares y por el mercado de futuros se anticipa que hoy habrá otra suba y es muy probable que de los $ 20,85 de ayer pase tranquilamente los 21 pesitos, pero todavía la denominamos “caminata cambiaria” porque, pese a la suma, no la podemos señalar todavía como corrida, aunque el monto es importante sumados a los 2000 millones de dólares de enero y que sumarian 5000 millones de dólares, que es lo que se perdería por los agro dólares de la sequía de la soja.



Pero a partir de ahora sí hay que contar cada 100 millones de dólares como parte de una minicorrida.


La explicación del gobierno es que fondos del exterior que estaban en LEBACs se fueron y, en segundo lugar, la suba de la tasa de los bonos del tesoro de los Estados Unidos que ayer llegó a 3,028%, pero hoy bajó más del 1%, cotizándose a 2,99%, así que hay causas locales que provocan la compra de dólares y la venta de dólares de BCRA y, en primer lugar, es la pérdida de credibilidad de la autoridad monetaria, que un día dice una cosa y otro día otra como, por ejemplo, decir que si la inflación no bajaba en mayo subía la tasa. Pues bien, ayer subió la tasa de LEBACs en el mercado secundario al 29%.
En conclusión, da la impresión de que mañana el dólar va a subir pero lo que es una incógnita es cuántos dólares venderá el Central.

In this case I can't believe that the presentment was not executed in time by Clearstream, so why didn't they want to pay them back?
A gross mistake or do CHF bonds also have a prescription time of only 10 years like most DEs and a Statute of limitations like in Germany?

In any case, I can't help pointing out that after 17 years, they try to find every possible excuse not to pay back bondholders.

That central custodian (Deutsche Bank?) which would have had to to present the bonds within the "contractual prescription period" (10 years also for CHF bonds?) have forgotten to do it(?). So these CHF bonds have been expired as of the MSA.

Prescribed Claims” means claims (whether for principal or interest) arising under defaulted Republic of Argentina bonds as to which the contractual prescription period set out in the relevant instrument evidencing those bonds has expired.

The contradiction is that the Argentines say that they would repay the CHF bonds if the bonds had been presented on time and the "certificate of presentment" for the CHF bond was available.
The DE bonds in central custody were in time submitted to the paying agent by the central custodian Clearstream as preconditioned in the MSA and I also sent the original Clearstream "certificate of presentment" to Mr. Colazo as he requested. Nevertheless, they do not want to repay the DE bonds despite the avoidance of the "contractual prescription" and sending them the original Clearstream "certificate of presentment". But the CHF bonds they would repay if the "contractual prescription" had been avoided and the "certificate of presentment" would be showed. It is all crazy....:wall::specchio:

If the contractual prescription period is longer than 10 years and/or there is a longer statute of limitations in Switzerland, the mystery is solved. Anybody has the O.C. and knows Swiss laws?

Looking for the O.C. in internet sould be possible to find it.

It is a good idea for you in trying to contact the arg lawyer or people in that office with the porpouse to get some answer and understand something about theyr action?
The best person is you as German talking and well engaged in the subject.
As you know that lawyer is STRBA in Frankfurt. In some paper I should have his exact address in the counter notice he made against me in Frankfurt Court. In the case ask me and I'll look for.

It does not need to tell you to keep with care all the documents that are necessary to prove that the prescription does not exist.

I think, the contractual prescription period could not be longer than 10 years in case of the CHF bonds otherwise user "caniss" would not have claimed that his CHF bonds had not been timely presented by his central custodian to the paying agent.

But anyway. Our problem are the DE bonds. Our DE bonds were timely presented in 2006 far within the 10 years "contractual prescription period". Thus the condition of the MSA was fulfilled.

The avoidance of 12 years "statute of limitation" was not a condition in the MSA. But also this "statute of limitation" was repealed by Argentina's moratorium declaration (debt acknowledgement) and (for your bonds) surely also by the Standard Offer presentation in February 2016.
BGH (Highest German Court) Judgment regarding paragraph 212 of the German Civil Code (BGB) to the Interruption of the statute of limitations by acknowledgment. BGH, judgment as of 20 June 2002 - IX ZR 444/00: "According to the case-law of the Federal Supreme Court, It is sufficient for an interruption of the statute of limitations by acknowledging any - even purely actual - behavior of the debtor against the creditor from which the awareness of the existence of the claim is - at least in principle - unambiguous...”

Una dura y áspera pelea tuvieron el vicejefe de Gabinete Mario Quintana y el presidente del Banco Central Federico Sturzenegger por la inestabilidad de la política cambiaria. Fue el miércoles, en medio del tembladeral que generó la venta récord de dólares para contener el billete.Este jueves el BCRA perdió aproximadamente otros US$ 900 millones. Pero la nueva reunión -y la única difundida- tuvo pasajes de tensión.Aranguren y Cornejo se hacían mutuas referencias, pero nunca se dirigieron la palabra en forma directa.Hay algo de lo que pocos hablan: la Argentina subsidia el precio de gas a las grandes petroleras y eso implica energía cara para la producción.La Unión Industrial evita mentar el tema. Por eso el tarifazo -como el factor cambiario- sufre por una instrumentación improvisada.Una clara evidencia fue el para muchos muy marketinero anuncio de María Eugenia Vidal: bajó polémicos impuestos que el año pasado no se cobraron.La cuestión tributaria surgió como un atajo de Cambiemos frente a la queja social.La improvisación se nota también a nivel nacional: hace pocos meses la Casa Rosada llevó adelante una reforma tributaria -la calificaron de “histórica”-, aunque nunca abordaron el tema de los tributos a las tarifas.Ahora está todo centrado en el Congreso. En esta difícil semana el titular de la Cámara de Diputados Emilio Monzó le advirtió a Macri: “Si esto no lo paramos a tiempo se puede transformar en una nueva resolución 125”.

Dear Mr. Colazo,

Thank-you for your email.

If a creditor tacitly (tacitly means that the creditor neither reminds nor sues) accepts the debtor's moratorium (moratorium means debt acknowledgement with only payment deferral), then a so-called “tacit agreement” between the debtor and the creditor ensues for the payment deferral. In this case, the statute of limitations is of course repealed. That was my case.

The German judgments which rejected the moratorium came out from lawsuits where the plaintiffs rejected Argentina's moratorium by filing a lawsuit for full repayment. Naturally if a creditor rejects the moratorium request of the debtor then the debtor cannot go on one-sided with it. In these case the statute of limitations of course could not be repealed and that is why the court rulings in favor of the time barred treatment.

So, as you can see my case and the case of the plaintiffs are completely different.
In my case are the bonds not time-barred because I have accepted Argentina’s moratorium and so in my case the statute of limitations was repealed.

Also, as said below in my previous emails, according to Argentina’s “Master Settlement Agreement” (MSA) only the 10 years “contractual prescription” (but not the 12 years “statute of limitations”) had to be avoided. That means that the “statute of limitations” issue is obsolete. So, it is also obsolete what the courts or paragraphs say because only the timely presentment of the bonds was preconditioned for the participation in the “Standard Offer”. Either the bonds were timely submitted to the paying agent within the 10 years of "contractual prescription period", or if not, then they are expired. My bonds in central custody were timely presented to the paying agent by Clearstream Banking in 2006, far within the 10 years “contractual prescription” period. As proof, I have already sent to you the original "certification of presentment".

Please help to find a good-faith solution.
